Liquid Alum (Aluminum Sulfate) Antitrust Litigation
Background
The plaintiffs brought this action alleging that the Defendants and their co-conspirators engaged in a continuing contract, combination, and conspiracy to artificially fix, raise, maintain, and/or stabilize the prices of alum within the United States in violation of Section 1 of the Sherman Act. Plaintiffs also allege that the Defendants and their co-conspirators agreed to, and did in fact, restrain trade or commerce by fixing, raising, maintaining and/or stabilizing at artificial and supracompetitive levels, the prices of alum.
Proposed DPP Class
All persons and entities that directly purchased aluminum sulfate within the United States from any Defendant or any predecessor, subsidiary, or affiliate at any time between January 1, 1997 through at least February 2011. Excluded from the class are Defendants, any parent, subsidiary or affiliate thereof, and Defendants’ officers, directors and employees.
Proposed IPP Class
All persons or entities who indirectly purchased (i.e. purchased from a wholesaler, distributor, or other third party intermediate supplier of Liquid Aluminum Sulfate), not for resale, which was manufactured, produced or supplied by Defendants or their unnamed co-conspirators from January 1, 1997 through February 28, 2011, in the following states: Alabama, Arkansas, Arizona, California, Colorado, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Puerto Rico, Rhode Island, South Carolina, South Dakota, Tennessee, Utah, Vermont, West Virginia, and Wisconsin.
